Scope

This Website is intended for Mortgage Professionals ONLY, and as such, the scope of this Website Privacy Policy applies ONLY to the use of our website and NOT to the collection and maintenance of Personally Identifiable Information (PII) or other consumer information that is required in the processing, closing, and servicing of AmMAC’s mortgage home loans.

AmMAC customers will receive information regarding the collection and maintenance of their PII in AmMAC’s Customer Privacy Policy which is delivered to all customers:

  • With upfront disclosures provided at the beginning of the loan process
  • With final legal loan documents delivered at the closing of the loan
  • Yearly by AmMAC’s loan servicer, Cenlar FSB

For this paragraph, customer is defined as a borrower who has consummated a loan with AmMAC and who is being serviced by AmMAC’s loan servicer.

Definitions

  1. Personal Identifiable Information is defined as information collected online about a consumer and maintained by the operator in an accessible form. The types of PII considered personally identifiable include the following:
  • A first and last name
  • A home or other physical address, including street name and name of city or town
  • An email address
  • A telephone number
  • Any other identifier that permits the physical or online contacting of a specific individual
  • Information concerning a user that the website or online service collects online from the user and maintains in personally identifiable form in combination with an identifier described above
  1. Consumer – Under the Gramm-Leach-Bliley Act (GLBA), a consumer is a person who has applied for a financial product or service from a financial institution that is used primarily for personal, family, or household purposes.
  2. Customer – for purposes of this Privacy Policy Statement, “Customers” means Mortgage Professionals such as licensed mortgage brokers and licensed loan originators
  3. Online Tracking – means the collection of data about an individual’s Internet activity used to deliver targeted advertisements or for other purposes

Amherst Funding Group, LP aka “AmMAC” and in New Hampshire, aka “Amherst Mortgage Acceptance Company,” operates the website at www.ammac.com (“Website”) for its customers and potential customers. Keeping our customers information secure and ensuring your understanding of how we collect, use and maintain such information is important to us. This Privacy Policy Statement (“Privacy Policy Statement”) describes how we collect, share, and safeguard your information collected through our Website.

BY REGISTERING FOR OR USING THE WEBSITE, YOU SIGNIFY YOUR ACCEPTANCE OF THIS PRIVACY POLICY STATEMENT. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY STATEMENT, YOU CANNOT USE THE WEBSITE.

We reserve the right to modify this Privacy Policy Statement at any time and will notify users in the following ways:

  • Upon login for registered and approved users

Location of Servers and Transfer of information to the United States

The Website is hosted by servers in the United States. If you are located outside of the United States, your Personal Information will be transferred to the United States. This Privacy Policy Statement applies to your use of our Website only. We do not own, operate or control the websites of third parties that this Website may link to. AmMAC provides links from its Website to several social media providers (e.g. Facebook; Twitter; LinkedIn). If you choose to follow any of these links, please review the privacy policies of these third party websites directly for information on their privacy, security, and data collection and distribution policies prior to disclosing any personal information on such third party websites.

Information We Collect

We collect PII from you only when you voluntarily submit it in order to obtain certain information, including without limitation:

  • When you register on our Website to gain access to our products and services
  • When you request more information about our programs
  • When you apply to become an approved broker
  • When you ask us to contact you

We use automatic data collection technology when you visit our Website to record non-personal information which:

  • Identifies your computer (operating system; your IP address; browser type and language, etc.)
  • Tracks your use of our Website (referring and existing pages and URLs, keywords, amount of time you spend on our “pages,” what sections of our Website your visit, and similar information concerning the navigation and use of our Website)

Retention Policy

AmMAC will retain the information of its registered and approved users that it collects from its Website as long there is activity (i.e. logging into the Website; uploading loans; contacting us via AmMAC Support, etc.). AmMAC will remove your information after twelve (12) months of inactivity.

How You Can Manage Cookies

If you turn off cookies, the pixel tag will simply detect an anonymous website visit.

AmMAC uses cookies and pixel tags to learn how visitors navigate through our Website. This helps us improve the Website by enhancing the navigation and functionality of the Website; securely maintain a session for existing customers accessing password protected areas, and to personalize certain aspects of a visitor’s experience (for instance, welcoming you back by name!)

How We Respond to “Do Not Track” Signals

We honor all “do not track” requests and settings. If you use any signal(s) or other mechanism(s) that provides you the ability to exercise choice regarding the collection of personally identifiable information about your online activities over time and across third-party websites or online services, we will not attempt to override such signals or mechanism, nor will we track your use of any such signal or mechanism. Who We Share Your Information With

We do not rent, sell, or share with third parties the PII we collect from you on this Site except:

  • As part of our Broker Approval process where we provide PII to a third party vendor to verify and validate information provided on our online Broker Application
  • To provide information or services that you have requested – If you contact us, we will collect Personal Information, which is referred to the appropriate department for research and response. The information we collect is NOT used in any other way
  • With your permission
  • With our service providers, to the extent necessary for us to administer and maintain the Website and provide you with our products and/or services

There may be special circumstances where it is necessary for us to disclose and use Personal Information and Non-Personal Information, such as:

  • Enforce this Privacy Policy Statement
  • To protect our property or rights
  • To protect the safety of anyone
  • To investigate, prevent, or take action regarding illegal or improper activities
  • To carry out a merger or consolidation with another entity
  • A sale or transfer of some or all of our assets

How We Protect Your Information

We take commercially reasonable steps to protect the PII and the Usage Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no data transmitted over the Internet can be guaranteed to be 100% secure. “Perfect Security” does NOT exist on the Internet, and you use the Website at your own sole risk. In particular, email may not be secure, and you should take special care in deciding what information you send to us via email. Do NOT send confidential information such as Social Security or account numbers to us via an unsecured email. Such communications should be sent to us by clicking on the AmMAC Support Center which is a secured email delivery application.

Children

This Website is directed to licensed mortgage professionals. We do not knowingly collect personal information from children through this Website. We encourage parents and legal guardians to monitor their children’s Internet usage and instruct their children to never provide personal information through any website without their permission. If you have reason to believe that a child has provided personal information to us through the Website, please contact AmMAC Support and we will endeavor to delete that information from our databases.

Correction/Updating Personal Information

If your personal information changes or if you no longer wish to use the Website, you have several options. You may:

  • Stop using the Website (after 12 months of inactivity, your PII will be removed)
  • Contact your Broker or your Broker Administrator to update your information through the Broker Admin link on the Website (insert link here)
  • Click on “Manage My Account” (insert link here) to reset your password

If You Choose NOT to use the Website

AmMAC ONLY conducts business with its customers electronically through its Website and by email messages. In addition to providing the ability for its customers to upload their electronic loan application files through its Website, AmMAC also provides email status updates to its customers throughout the loan process.

Therefore, should you choose to remove your PII through one of the options listed above, you will no longer be able to conduct business with AmMAC.

In order to ensure that our customers understand this provision, AmMAC provides a message to its customers each time a loan is uploaded to our site indicating their understanding and acceptance of AmMAC’s electronic processes.
